Summary: CRIME/PUNISHMENT:
Provides with respect to criminal penalties for third, fourth, and subsequent DWI offenses.

 

Senate Bill 679 and what it will actually do create more harm and death in our state:

 

Present law provides that third, fourth, and subsequent offenders shall be required to

participate in a four to six week inpatient substance abuse program and may be sentenced to

additional substance abuse treatment services not to exceed 12 months.

Proposed law provides that the court may order the offender to participate in an inpatient

substance abuse treatment program, or any other court-approved substance abuse treatment

program.

The key issue in this bill----shall to may---shall provide funding---may provide it!  In other words lets get rid of treatment by doing it covertly!!!  We already see what the lack of standards has done for funding treatment for 1st and 2nd offenders this bill is bad legislation and simply ends treatment that is working to save lives on our highways!

This portion of the law should be removed- If you are an alcoholic we seize your car and give the money to some throw away project---this money should go into a treatment fund at the very least!?

Present law provides for the seizure and sale of a vehicle being driven by the offender at the

time of the offense and provides for procedures to be used in those circumstances.

Contact this Committee Tell them you support treatment, and oppose SB 679 that would end mandatory treatment for 3rd and 4th DWI offenders, currently the ONLY mandate for treatment for any DWI offense.
Tell them Alcoholism is not a crime, but a disease, and that treatment and recovery support works!
If they can fund prison--they can fund treatment!
